This website provides information about the proposed class action settlement concerning the enforcement of red light violations by unmanned cameras in certain municipalities in the State of New Jersey prior to August 1, 2012.

On January 13, 2008, New Jersey Assembly Bill 4314 was signed into law as New Jersey Statute, Title 39, Chapter 4-8.12, et. seq., known as the New Jersey Red Light Camera Statute.  This red light camera statute established a five-year pilot program that authorized the installation and utilization of red light camera monitoring systems in New Jersey, and set minimum statutory requirements for the operations of such systems. The New Jersey Red Light Camera Statute authorized certain municipalities to erect red light camera monitoring systems and issue Notices of Violation to vehicles who violated a red light.  The New Jersey red light camera statute also provided that red light violations could be detected by unmanned cameras, and that Notices of Violation imposing fees or fines could be issued to the registered owner of the vehicle so detected.

This lawsuit alleges that the Defendants, for a period of time, were non-compliant as to specific requirements contained within the New Jersey Red Light Camera Statute. Plaintiffs brought this lawsuit on their own behalf and on behalf of all operators or registered owners of a vehicle, who paid a fee or fine in response to a Notice of Violation arising from the New Jersey Red Light Camera Statute, issued by or  on behalf of New Jersey municipalities that have contracted with American Traffic Solutions for red light camera monitoring systems, where such violation occurred on or before August 1, 2012.  Although Defendants deny Plaintiffs’ allegations, the parties have reached a settlement which encompasses this class.  This settlement was approved by the United States District Court, District of New Jersey.

As a result of the settlement, an eligible class member may be entitled to a one-time payment of at least $8.50 in addition to other relief. 

To be an eligible class member in this class action settlement, (1) you must have been issued a Notice of Violation for a violation arising from the New Jersey Red Light Camera Statute; (2) the violation must have been issued by or on behalf of New Jersey municipality that has contracted with American Traffic Solutions for red light camera monitoring systems; (3) the violation must have occurred on or before August 1, 2012, (4) you must have paid the fee or fine associated with the Notice of Violation, and (5) you must have not received a full refund of your payment.
